Whether your company owns, licenses or merely maintains personal information about your employee, nearly every state has requirements on when and how affected individuals must be notified of a data breach, and many states also require notification be made to state attorneys general, consumer protection agencies, national credit bureaus, and perhaps even the media. Third-party payroll and benefits companies are only obligated to notify you, not necessarily your employees, in the event of a data breach. Employers who suspect personal information about employees may have been compromised should immediately contact legal counsel.

Many business owners view distributing discretionary bonuses as a way of showing appreciation for their employees. The problem is these bonuses are often based on subjective “feelings,” which can often be found to be discriminatory. Instead, we encourage business owners to stick to objective criteria for bonuses and to write a personal thank-you-note to exceptional employees instead. Generally, vacation pay, holiday pay, bonuses, sick leave and severance pay are examples of wage agreements, which may be made between employers and employees as a part of the employee’s total compensation package. There is no requirement to offer these benefits. But you are required to honor any already established policy or agreement relating to the payment of benefits such as accrued vacation or severance pay upon termination. If the employee qualifies and is eligible for benefits, you should pay those upon termination as well. You want to verify with your state law as some states may vary.

If an employee receives a jury duty notice at a critical time for your business, you can file an exemption by writing a letter to the court explaining the circumstances and honorably requesting that the employee be relieved of jury duties because it would place undue hardship on your business. The judge may excuse your employee from acting as a juror or defer that service; however, a request for excusal does not necessarily mean the court will grant the request, and you must not discharge or retaliate against an employee who chooses to perform jury service despite your objections.
Building service contractors often partake in intense physical labor. These can lead to lots of aches and pains in the body. Mindfulness or awareness attention training can help. Try a body scan. All you have to do is lie down somewhere quiet and take your attention to each of your body parts, starting from your feet all the way up to your head. Take deep breaths with every part you take your focus to new heights. You might notice that your tension areas relax through this process. Sometimes all your body needs is a little attention.
